Solitary Confinement and what it does to Your Mind Essay Try picturing this; you are locked in this cell for 23 hours a day. The cell is small about 6 feet by 8 feet. In the cell there is a steel toilet, a sink built in the top. There is also a steel bed with a very thin matress.There is small shelf for some of your personal items, and a desk hanging off the wall without a chair. There is a window that is about 5 inches wide and about 4 feet tall, but you cant see out of it. Its made of fog clouded glass. The window is also covered with steel with little holes. What Im describing is a cell in a section of a prison called solitary confinement. While prisoners are in solitary confinement they are forced to be in this tiny cell for 23 hours a day. They are only allowed to come out for recreation five times a week for one hour. Their rec in a cage. They are allowed to take three showers a week, and it can only be for five minutes. Solitary confinement is the confinement of a prisoner in a cell or other place in which he or she is completely isolated from others. In my opinion Solitary confinement is barbaric, and does more harm than it does justice. These criminals are being released back into their neighborhoods after being locked up with no human contact for years. Solitary confinement has been around since the 19th century and mental instability has been linked to solitary confinement since the 1860s. Prison records from the Denmark institute during 1870-1920 shows that staff noticed inmates were showing signs of mental illness while in isolation, revealing that this persistent problem has been around for decades. Solitary confinement was developed as a humane alternative. In 1970, the Quackers built Walnut Street Jail in Philidelphia with a, â€Å"Revolutionary and too many humane purpose. The jail was meant to punish and reform. Walnut Street is known as the Birthplace of the modern prison system. There are two types of solitary confinement that are commonly used today. One type is called disciplinary segregation. This is when youre in solitary for a week or two for doing something like stealing a cellmate’s radio. Another type of solitary confinement is known as admistrative segregation. This segregation is used when inmates are deemed a risk to the safety of other inmates or even prison staff. When youre in administrative segregation you can be isolated for month’s even years. In my opinion Solitary Confinement can ruin someone’s mental and their life. Solitary confinement used to be when prisoners would get thrown in the whole, and stay there for a couple of days. Now prisoners are in solitary confinement for years. Just imagine yourself locked in a room with just a bed for years. Would you still be sane? I dont think anyone would come out of that the same person they were before they entered into solitary confinement. Solitary confinement has been recognized as difficult to withstand. Psychological stressors such as isolation can be as clinically distressing as physical torture. But ironically U.S prisons have increasingly embraced solitary confinement to punish and control difficult or dangerous prisoners. The prisoners live with extensive surveillance and security controls, the absence of ordinary social interaction, abnormal environmental stimuli, with sometimes just three to five hours a week of recreation alone in caged enclosure. They only have little, if any educational, vocational, or other activities. Isolation can be psychologically harmful to anybody, and any prisoner. The effects of solitary confinement can have a very strong impact on prisoners that already have a mental disorder. Suicides occur more often in the isolation sections of the jails. Being isolated for a long period of time takes a toll on your mental state. Many prisoners have said they dont know how to interact with other human beings after being in isolation. In 2007, researchers at the University of Washington reported that prisoners released directly from super max prisons into the community have committed new crimes sooner than prisoners who have been released from segregation back into general population for several months before being released. After being locked up in solitary confinement some prisoners find I hard to socialize and suffer from post-traumatic stress disorder. Some have said they can be around people and still feel alone. Some inmates have reported that have emotional breakdowns, and don’t know why. One prisoner I read about named Anthony Graves said, â€Å"That solitary confinement is the worst inhumane treatment to a man.† After someone has been locked away in a tiny cell for 23 hours I don’t know how people can think that wouldn’t have a negative effect on someone. Previously healthy prisoners have developed clinical symptoms usually associated with psychosis or severe affective disorders â€Å"including all types of psychiatric morbidity† Many have committed suicide. Individuals do vary in how well they can deal with living in isolation, however. For prisoners with pre-existing mental or emotional disorders, living without normal human interaction, physical and mental activity and stimulation can aggravate their symptoms to levels equivalent to torture. In one complaint filed against the Connecticut Department of Correction in August 2003, social isolation and sensory deprivation drove some prisoners to lash out by swallowing razors, smashing their heads into walls or cutting their flesh. I read an article about Mississippi prison. In this article it talked about how at one point in time the inmates kept in solitary confinement for up to 23 hours each day, allowed out only in shackles and escorted by guards, they were restless and angry made more so by the excrement-smeared walls, the insects, the dirty food trays and the mentally ill inmates who screamed in the night, conditions that a judge had already ruled unacceptable. So it was not really surprising when violence increased in 2007: an inmate stabbed to death with a homemade spear that May; in June, a suicide; in July, another stabbing; in August, a prisoner killed by a member of a rival gang. After all of this happened instead of the prison tightening stricter restrictions the y loosened them. They allowed the prisoners out longer. They built a basketball court, and a group dining area. They set up rehabilitation programs, and allowed the prisoners to work towards greater privileges. In response to these changes the Mississippi prison atmosphere changed. The prisoners were better behaved, and the violence went down. I read an article about a man named Daud Tulam, who spent 18 years in isolation at the New Jersey State prison. He spent 23 hours a day alone in in a cell no bigger than a bathroom, and he had one hour in a concrete exercise yard. Tulman was sent to isolation because prison officers caught him trying to attack another prison officer. After being in isolation for 18 years Tulman has trouble making small talk. Tulman doesn’t engage in conversation even after being out of jail. Tulman is taking a welding class, and he often hides in the back of the class. When the teacher looks at his work, he doesn’t even make eye contact, but just looks at the floor. Tulman has lost all his social skills. I read another article about a correctional officer named Gary Harkins, who worked in a prisons isolation unit for 25 years. Before reading this article I never even considered the effect isolation could have on the workers. Gary worked for Oregon State Penitentiary. In the article he states that he didnt really understand how much stress he was under. At night Harkins would dream about his work, he felt like he couldnt get away from his job. He worked in giant, windowless, gray prisons, and it would be months until he would get to see the sun. He was in the isolation unit for 12 hours a day. The prisoners and officers didn’t interact like they interact if they were in general population. Harkins began to feel trapped as if he were one of the prisoners. I watched documentary called Lockup, and it featured an inmate named Bobby Ray Gilbert known as snake who spent 19 years in admistrative segregation. Gilbert was convicted of robbery, assault, escape and two counts of murder. Gilbert expressed in the documentary that being in isolation changes the way you think. He said he day dreams about blowing the prison up and killing everybody in it. During the documentary Gilbert attempted to starve himself to death after he found out he was going to be transferred to a prison close to home. I watched another documentary about Solitary Confinement. In this documentary it featured an Inmate by the name of Jusue Gonzales. In this documentary you can see how all Gonzales does is walk back and forth. He said that he can actually see imprints in the floor, where another inmate was doing the same things he’s doing. In this documentary Gonzales expresses that it hurts being locked up in that cell. He said sometimes he just cries. In this documentary the prison guards say that the prisoners are so desperate for human contact that they will do something negative just to get a reaction. These inmates will go to extremes just to get some human contact. Humans depend on other humans for survival. So when there is no type of human contact, these prisoners feel all alone. They start to feel helpless. As I stated before I think that solitary confinement is UN lawful and doesnt do any good. I think that solitary confinement should be banned, or at least be used for up to 2 days. When I hear of inmates being in solitary confinement for years just sound crazy. I know I couldnt last being locked in my room for an hour. When someone is locked away in a tiny cell for 23 hours out of the day, it’s really rare they come out sane. I think as a society we need to find other alternatives to really rehabilitate these individuals. Solitary Confinement is no longer working. The conditions are way too inhumane. In my opinion solitary confinement is just creating animals. You are leaving these angry men and woman in a tiny cell with little to no human contact for 23 hours out of a day. Do you really expect someone to come out rehabilitated and ready to do well? No, they are just going to come out of jail angry and bitter, and most likely end back up in Solitary Confinement. In March 2010, PG voluntarily recalled its Pringles Restaurant Cravers Cheeseburger potato crisps and Pringles Family Faves Taco Night potato crisps in response to a recommendation from the Food Drug Administration (FDA) to the food industry to protect consumers from potential Salmonella exposure. Most recently in June 2010, PG voluntarily recalled a small percentage of 1-liter bottles of Scope Original Mint and Scope Peppermint mouthwash with malfunctioning child-resistant caps in the US and Canada. Recurrent product recalls could affect the brand image of the company, which would lead to low customer loyalty and brand equity. Excessive dependent on Wal-Mart PG is heavily dependent on Wal-Mart Stores (Wal-Mart) and its affiliates for generating major part of its revenue. Sales to Wal-Mart and its affiliates represented approximately 15% of its total revenue since 2006. High dependence upon a Wal-Mart reduces the bargaining power of the company. Also, Wal-Mart could use its bargaining power to impose unfavourable terms on the company. Any decrease in revenue from Wal-Mart could have a negative impact on the companys businesses. Hence, the loss of this customer will lead to a sharp decline in PGs revenues and also a loss of its market share. OPPRTUNITIES Future growth plans In order to grow in a highly competitive environment, PG is pursuing a clearly drafted strategy with focus on two areas: increasing concentration on its core attractive businesses and enhancing its customer base. The company is sharply focusing on its core attractive businesses (the beauty and health market segments and several household care categories) as these are fast-growing businesses. For instance, the global market for personal care products has annual sales of over $39.5 billion and is growing at a rate of around 5% annually. PG intends to increase its customer base by acquiring under served and unserved consumers. In line with this, the company is targeting developing markets; extending its distribution systems; and expanding its brand and product portfolio. Developing and emerging economies are expected to account for 90% of the worlds population by 2010, and this is expected to drive demand for fast moving consumer goods. Increased investment in manufacturing capacity in developing countries PG is planning the biggest increase in its manufacturing capacity in order to expand into categories and countries where it doesnt have a brand presence. The company is investing 4% of sales in capital spending, including funding for new manufacturing capacity to support future growth. Over the next five years, PG plans to add 20 new manufacturing facilities. Almost all of these facilities are in developing markets, and almost all will be multi-product category facilities. By focusing on developing markets, the company would reduce the cost of serving these markets while also being closer to regions with the greatest long term growth potential. Does ‘Pascal’s Wager’ Provide a Convincing Argument for Belief in God? Essay

Published in 1670 and named after French philosopher and mathematician Blaise Pascal; the philosophical theory of Pascal’s Wager reasons that to believe in God is a decision made in a time of uncertainty. The Wager also explains that whether or not God exists, we can estimate the outcome; an infinite reward or an infinite punishment. This suggests that the rational choice to live as if God exists is the better of the possible choices; yet, through reason alone, one cannot come to the knowledge of God’s existence. Many people’s beliefs may be in their own interest to hold, thinking, if we plan for the future it will pay off in the long run; or in other cases, we explain why somebody holds a belief by appealing to its causes. This being said, the idea of the Wager is deciding whether or not to believe in God and to consider the expected outcome for each of these options. I think that Pascal’s Wager is supposedly meant to provide reasons which would persuade any rational person that they should believe in God. However, I don’t think it is a valid argument, although it is convincing. The argument of Pascal’s Wager can be used for any God at all, so what happens if you pick the wrong God? Who is to say this God actually rewards belief and punishes those who do not believe? If we supposedly were to pick a god and it does exist, won’t this omniscient god know that we only believe just to be safe? Would our outcome still be an infinite reward, or would we not be rew arded for our fake belief? I don’t think we can be guaranteed any specific outcome, such as an infinite reward or infinite punishment, because if you believed in a god because you wanted to have chance on your side, then the God would know this, and would know that your belief was not real. The belief in God relies on assuming that the god described is real and has those characteristics. The argument of Pascal’s Wager begins with an assumption, and then appeals the same supposition as its conclusion. You have to believe this assumption in order to believe in God and if you do not believe the primary assumption about God already, then the argument should not convince you. Therefore, if there is no God, no afterlife, no continuation and you wasted your time maiming yourself and your kids, eating a restricted diet or giving your time to faking a belief in God, you have missed a lot in the only life you have. The only certain result of Pascal’s Wager is that one will pretend to believe, which is all one can do if they do not really believe. Yet, if there is a god, he would know that you are faking it so you would go to hell anyway. The Wager gives us an option to believe in God in times of uncertainty; suppose your dog who you love dearly lay next to you close to dying, and the vet offers to try a new drug to cure the dog, however, could not guarantee treatment. The drug has a 50-50 chance of saving your adored dog’s life. Would it be sensible to try it, even if it cost a bit of money? Supposing it was free, it would be unreasonable not to try it and reasonable to try it. This is an example understanding the Wager in a time of doubt and uncertainty; to believe in God not because your reason can prove with certainty that it is true that God exists but because your will pursues happiness, and God is your only chance of attaining happiness eternally. In my opinion, the argument of Pascal’s Wager, is not a valid argument, however, it is a convincing one. When you first hear Pascal’s Wager, it sounds good, but in fact, it depends on whether an individual chooses to believe.. Most disbelievers, such as me, question the Wager purely because we know of no persuasive evidence or reasons to believe; maybe proving the argument or showing some good evidence might convince unbelievers. To say it is in someone’s ‘best interest’ to believe in God is completely unsound, especially considering someone cannot sincerely choose to believe in something, just because it is rationally logical to do so. If you said all the right prayers and attended church on a regular basis, that still would not be the same thing as truly believing, any omnipotent, omniscient, omnibenevolent God would see straight through that. . I do not think by act of will, that you can force yourself to believe that God exists. This argument is logically invalid, but people are afraid of an infinite punishment, or the final outcome of choosing to believe in god, therefore are easily convinced by rationally unsound arguments.

Registry also contains information about Windows (95/98/NT) and about your Windows configuration. The Registry database is stored as a binary file. To find it, run regedit.exe (Windows registry editor utility) in your Windows directory. You will see that information in Registry is organized in a similar way to Windows Explorer. We can use regedit.exe to view registry information, change it or to add some information to it. It is obvious that modifications of the registry database could lead to a ​system crash (of course if you dont know what you are doing). INI vs. Registry It is probably very well known that in the days of Windows 3.xx INI files were a popular way of storing application information and other user-configurable settings. The most terrifying aspect of INI files is that they are just text files that the user can easily edit (change or even delete them). In 32-bit Windows Microsoft recommends using Registry to store the type of information that you would normally place in INI files (users are less likely to alter registry entries). I envisioned the war fields dotted with machinery, trenches and fortresses that helped to protect the heroic men who fought continuously until the end. I pictured the victorious soldiers returning home to accepting and joyous companions whom they had been away from for so long. Not once did I think of the women volunteering for the war. I figured they simply sat at home praying for the safe return of their loved men. However, in closer examination of The Great War, I have learned of my naivety. In reality, women were as much a part of the war as were men. Although women played distinctly different roles, their experiences were often virtually indistinguishable to those of their male comrades. For example, women and men had the same pressure put upon them to volunteer for the war. Once involved in the war, both genders were forced to question their previous beliefs and their learned virtues while discovering that this great war wasnt what had been expected. Men and women had to suffer from extremely horrible living conditions, face the fact that they were simply a number to the country they were fighting so valiantly for and learn to psychologically deal with experiences nobody had ever fathomed before. And when those who were lucky enough to survive returned home, they had to reevaluate their relationships with those they had left behind, often times discovering that the only thing that war had provided was an uncertain future. I often wonder if as many men and women would have volunteered for the war if they had known what they were up against beforehand. Service User and Carer Participation in Social Work Identify, using examples, how a professional social worker should work in such a way as to ensure user and carer participation. Consider the practice issues for working anti-oppressively with users or carers who are either a  frail elderly person and their carer. A professional social worker must approach the elderly person as an individual and ensure that individual as opposed to generic needs are assessed. In practical terms this means that the approach taken is built upon a mix of professional pragmatism and textbook rules. This manner of approach also ensures that the social worker can approach the practice issues identified in an anti-oppressive and professional manner which promotes both user and carer participation. Certainly in terms of personal reflection, and from the writer’s perspective; as a white, middle class person, integrating the theory of how one is required to engage oneself anti-oppressively, in the capacity of social worker with the pragmatics of good social skills and an ability to put a user, such as a frail elderly person and their carer at ease is all the more important where there are differences between the practitioner and the service user in terms of age, race, religion and sex to name just a few examples. Therefore promoting user and carer participation and working anti oppressively with frail elderly users is by no means an easy task. Such a task requires an understanding of models of oppression. Models of oppression mainly relate to the ‘isms’ within society such as ageism, sexism, classism, racism and many others (Williams, (2002) 1), and in the context of this question perhaps ageism and its avoidance within a user/practitioner setting is the most relevant. The professional social worker must be aware that models of oppression must be understood and applied within carer/user settings in order to promote an ethical, participatory relationship between the two (Cambridgeshire and Peterborough Mental Health Partnership NHS Trust (2006) 14). This is because as Beckett and Maynard ((2005) 46) observe, the social worker often deals with those groups within society who are the ‘least powerful’. One classic example of this for the social worker in a practice situation could be at a juncture where a frail elderly person reaches a stage where their needs cannot be accommodated at home, and supported accommodation options for the elderly person may need to be discussed. In this instance ‘alone time’ spent between carer and the social worker and the user and the social worker can allow both to discuss the issues at hand frankly, and decide what the best way forward might be. This ensures that there is holistic user participation, as it is important that the needs of a frail elderly person are not entirely overshadowed by the input of the carer. This by no means implies that the carer should be ignored during a home visit, or should be excluded in any manner, but there will be times when it is appropriate for the frail elderly person (provided they are compos mentis) to express their viewpoint independently of those close to them (for example if they express a wish t o have arrangements made for a will). This will also give the social worker an opportunity to have some time alone with the carer, which gives the carer an opportunity to raise concerns or to discuss issues which they would perhaps not feel comfortable raising in the presence of the person who they take care of. Of course, the user participation will be important once these discussions have taken place, because a frail elderly person cannot be placed into supported accommodation without their co-operation and consent. However, it is often beneficial, where a sensitive issue should as a move between home and supported accommodation is to be broached, that a carer and a professional social worker have an opportunity to discuss the needs of the ‘user’ of the services in a setting where these issues can be spoken of frankly. This does not mean that issues should be concealed from a user or from a carer, but often in terms of facilitating anti-oppressive practice issues it i s appropriate to relate to both user and carer in different ways, and therefore it may be necessary to communicate with one or another (user and carer) separately. In this context the issue of power within society and how it relates to social inequalities must be understood. The social worker is in quite a powerful position compared to an elderly and frail service user, and therefore a professional social worker is required to appreciate how their language must be employed as a strategy to engage the service user, and carer anti oppressively, and at the same time promoting participation. To take stock of another example to illustrate this point, let us look at a scenario whereby an elderly person who is frail is hostile to interventions from a social worker. Here, the requirements for anti-oppressive techniques of care become all the more important. Difficult questions become apparent in this context. Some examples are as follows: What should one do whereby a frail elderly person has a carer who looks after their needs on a part time basis, and the social worker feels that there are issues of self neglect during episodes where the carer is not present? To take this example a little further, a scenario could arise where a frail elderly person, whose carer is not present, is being visited by a social worker. Let us imagine that the social worker wishes to gain entry to the house of the elderly frail person in order to assess their needs and the elderly person is suspicious and does not wish to allow the person in. How can language be employed in this setting to promote an ethical relationship based on anti-oppressive techniques in this scenario? A simple answer would be for the social worker firstly to explain who they are and why they wish to pay a visit to the elderly person, and secondly another strategy which could be employed would be to say to the service user (the elderly frail person); Can I come in for a Chat/some Tea?, rather then an overly formal explanation of why they are there for example ‘I have to speak to you to assess whether you are capable of looking after yourself’. This approach also empowers the service user, since they may feel more in control of the interaction, and they might also be more inclined to perceive the social worker on friendly terms. To pose another critically important question here: how should a social worker in this above outlined scenario handle a conflict which arises between an elderly user and the state where an elderly person, who lacks capacity to make decisions for themselves is self-neglecting and will not co-operate with a social worker who encourages them to move into supported accommodation? Two models of intervention may be employed here by the social worker, to deal with the conflict. One is the state intervention model, which may involve sectioning the frail elderly person and removing them into the care of an institution, and alternatively the social worker can choose to employ more moderate interventions which involve living support from voluntary sector groups (Scottish Executive (2006) Section 1.3). Which one is best always depends upon the individual circumstances of the frail elderly person, and the judgement of the individual social worker[1]. In this context, and to continue the reference to the particular example where a social worker wishes to gain entry to the house of a frail, elderly person for the purposes of assessing their needs, it is also important to remember that the social worker owes the frail elderly person some legal responsibilities. All social work practitioners, for example are required to adhere to the various codes of ethics which have been issued through the General Social Care Council, which was set up in 2001. Amongst other duties, each of the 84000 social workers and social worker students on the Social Care Register must submit to inspection by the Commission for Social Care Inspection, and are required to have their own copies of their codes of conduct; and also as of 2003, the Social Care Register requires that only registered social workers may describe themselves as social workers (to label oneself a social worker, and at the same time intending to deceive others in this respect is now a crim inal offence) (www.gscc.org.uk). Another legal responsibility which the professional service user owes to the user and to the carer is the duty not to discriminate unnecessarily against a person on the grounds of their race, ethnicity, disability, and age to give just a few examples of areas which are protected by law by anti-discrimination legalisation. Research into what practice issues are important for services users including carers and the elderly which was carried out by the Cambridgeshire and Peterborough Mental Health Partnership NHS Trust suggests that the combating of discrimination and how it can lead to an oppressive relationship between service user and social worker is very important in social work practice (Cambridgeshire and Peterborough Mental Health Partnership NHS Trust (2006) 14). In terms of both user and carer participation, the issue of confidentiality is of the utmost importance. This builds trust between user and the social work practitioner and also may lead to a feeling of empowerment by the service user, who is in the context of this question a frail elderly person. To refer back to the first example used in this essay (where the issue of perhaps assessing the needs and views of both carer and an elderly frail person separately has been raised); where there are issues which are quite sensitive between a carer, and a frail elderly person, it is important that the confidence of both parties are respected by the social worker. It is also important to speak to each person on their terms. One classic example of this in the context of a frail elderly person, addressing the user firstly by using their formal title ‘Miss Jones’ for example or ‘Mrs Smith’, as opposed to the use of first names is potentially an important strategy to emp loy. It is often the case that there will be a large generational gap between the frail elderly person and the social worker, and this makes to concept of anti-oppressive techniques and participation techniques all the more important. Such a generational gap may make a frail elderly person perceive the social worker as more of a threat to them, and may perhaps convey to them the impression that the social worker has little understanding of their needs and view of the world. In this sense, also good case management and record keeping (often a legal requirement for social workers) will also facilitate user and carer participation, as well as anti-oppressive practices. In conclusion therefore there are a plethora of practice issues which are pivotal in a scenario where a social worker is required to interact in a professional capacity with a frail elderly person and their carer. All of these issues are intersecting, related, and sometimes contingent upon each other. The requirements for user and carer participation and for an understanding of anti-oppressive techniques are therefore complex concepts which require a pragmatic approach, integrated with a theoretical approach on the part of the contemporary professional social worker. How John Keats used Symbolism in his â€Å"Ode to a Grecian Urn†   Ã‚  Ã‚  Ã‚  Ã‚  John Keats was born in 1795 in Moorfields, England. He was the son of a stableman who married the owner’s daughter and eventually inherited the stable for himself. He was fourteen when his mother died of tuberculosis. Having been apprenticed to an apothecary at the age of fifteen, John felt the need to leave medical field to focus primarily poetry. Keats’s imagery ranges from all of our physical sensations: sight, touch, sound, taste, and sexuality. Keats is one of the most famous for his Odes. Traditionally, the ode is lengthy, serious in subject, elevated in its diction and style, and often elaborate in its stanza structure. â€Å"Symbolism seems the obvious term for the dominant style which followed nineteenth-century realism† (Wellek 251). According to an article found in Jstor journal, written by Vyacgeslav Ivanov, titled, Symbolism, â€Å"symbols are far from being an invention and convention of mankind, constitute in the universe, all pulsating with life, a primordial imprint in the very substance of things and, and it were, an occult language by means of which is achieved a preordained communion of innumerable kindred spirits, no matter how these spirits may differ in their individual modes of existence or whether they belong to different orders of creation† (Ivanov 29). Keats uses symbolism in â€Å"Ode to a Grecian Urn† to illustrate his love for ancient Greece.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã¢â‚¬Å"Ode to a Grecian Urn’ was written by John Keats at some unknown date. â€Å"The Urn, as Keats described it, was a classical vase, decorated with a frieze of engraved figures in scenes from pastoral life. In reality it was more than any particular vase which he had seen on his museum excursions with Haydon or Severn. The Grecian Urn represented poetic vision, the timeless, enchanted world into which the artist’s imagination alone can enter,† as stated in Robert Gittings and Jo Manton’s book titled The Story of John Keats (Gittings and Manton, pg. 148). In this poem Keats wants to create a world of pure joy, but the world is of make believed of people living in a moment in time. In an article titled, â€Å"Thought is sacrificed to sensation in the poetry of John Keats,† author Iain Morrison states that â€Å"Existing in a frozen or suspended time, they cannot move or cha... ... to know.† The beauty lies in the urn. â€Å"What the imagination seizes as beauty must be truth,† as stated by Catherine Owens Peare, author of a book titled John Keats a Portrait in Words. â€Å"John Keats’s â€Å"Ode on a Grecian Urn† was both inevitable and incredible. It was inevitable that he should by now have struggled free of the sonnet with its fourteen-line prejudice to create this ten-line stanza and its two pairs of lines and two sets of triple rhymes, inevitable that in developing his own style he should have resolved his philosophic search at this his period of most superb creativity† (Peare, pg. 174). Douglas Wilson’s article in Jstor titled â€Å"Reading the Urn: Death in Keats’s Arcadia,† â€Å"Like Blake’s â€Å"Mental Traveler† and so many other Romantic poems, â€Å"Ode on a Grecian Urn† invites the reader into a landscape of consciousness. As S.T. Coleridge puts it, the primary function of the poetic work, like the visual language of painting, is â€Å"to instill energy into the mind, which compels the imagination to complete the picture. The ode’s speaker responding to an imaginary urn conjures up, as part of a mental dram, the underside of a vanished culture that created such urns† (Wilson 823).

In the early years of the Civil War it became clear that disease would be the greatest killer. Twice as many Civil War soldiers died of disease then that were killed in combat. This was due to unsanitary and filthy conditions, untrained Medical personnel and poor medical examination of new soldier’s. One fact from the Civil War was 315,000 soldiers died from illnesses that included: 44,558 from diarrhea/dysentery, 10,063 from malaria, 34,833 from typhoid, 958 from typhus and 436 from yellow fever. The sanitary conditions that a cured during the civil war was shocking. Unsanitary hospitals and camps kept the wounded soldiers in large groups, which were ideal places for infection, fevers and disease to spread. Soldiers were not immune to childhood diseases like the measles and small pox. Medical science had not yet discovered the importance of antiseptics in preventing infection. Water was contaminated and soldiers sometimes ate unripened or spoiled food. There weren’t always clean rags available to clean wounds. Because of frequent shortages of water, surgeons often went days without washing their hands or instruments. So now germs were passing from patient to patient. The Civil War was fought at the end of the middle Ages; therefore the Medical Corps was unqualified in all fields of medical care. Little was known about what caused disease, how to stop it from spreading, or how to cure it. Surgical techniques ranged from the tough to easy. Underqualified, understaffed, and undersupplied medical corps, who was often referred to as quacks and butchers by the press, took cared of the men in the Civil War. During this period a physician received minimal training. Nearly all the older doctors served as apprentices in lieu of formal education. Even those who attended one of the few medical schools were poorly trained. The average medical student trained for two years, received no experience, and was given virtually no laboratory instruction. Still, another reason for disease being the greatest killer in the Civil War was the bad medical examinations of recruits. The recruiting process allowed underage, overage men and those in noticeably poor health to join the army on both sides. Two hundred thousand recruits originally accepted for services were told to be unfit and discharged, either because they had become ill or because a routine examination revealed their bad condition.

Per your request, I was delegated the duty of developing the Employment Law Compliance Plan for Bradley Stonefield and his limousine company. Based on the meeting notes, Mr. Stonefield wants to operate a limousine company in Austin, Texas and to have at least 25 employees working for him within the first year. To ensure the success of Mr. Stonefield’s business, I have developed an employment law compliance plan that he should follow. This communication serves as confirmation of the employment laws that are relevant to Mr. Stonefield’s business. It will also provide how the employment laws should be executed and the consequences of noncompliance. This memo will give information regarding federal employment laws and regulations specific to Texas. The laws that will be discussed are The Texas Minimum Wage Law, The Age Discrimination in Employment Act of 1967, The American with Disabilities Act of 1990, and the Immigration Reform and Control Act of 1986. The Texas Minimum Wage Law Texas implemented the federal minimum wage rate of $7.25 per hour in July 24, 2009. Another provision of the law allows automatic increases in the minimum wage amount when the rate of the federal rate increases. The law also  mandates employers provide its employees a paycheck statement, which shows the number of hours an employee has worked (including overtime), the amount of pay they received, and any deductions. The Texas Minimum Wage Law aims to ensure that all employees are treated fairly and equally, regardless of where he or she may fall on the pay scale. Mr. Stonefield’s limousine company can comply with the Texas Minimum Wage Law by ensuring payroll is processed correctly. Additionally, the company should save records of all payroll, for the mandated period, for future references and ensure that the pay rates comply with the minimum wage law. Mr. Stonefield can purchase payroll specific software and individuals skilled in payroll processing to ensure compliance. The Texas Department of Labor enforces the Texas Minimum Wage Law. Individuals of the department of labor audit businesses to confirm the business is operating according to this law. If a business is found to be noncompliant, they could be fined up to $10,000.00 and criminally prosecuted. If the business is in violation for a second time, the business owner may be imprisoned. Penalties of up to $1,100.00 per violation can be executed to employers and businesses who repeatedly violate the minimum age requirement. The Age Discrimination in Employment Act of 1967 The Age Discrimination in Employment Act of 1967 prohibits discrimination in benefits, salary, and employment for employees who are age 40 and over. However, if the employer can validate that age is an occupational qualification, this law would not apply. The law is administered and executed by the Equal Employment Opportunity Commission (EEOC) and â€Å"[a] key objective of the law is to prevent financially troubled companies from singling out older employees when there are cutbacks† (Cascio, 2013, p. 109). To comply with the Age Discrimination in Employment Act, Mr. Stonefield’s limousine company cannot deny employment or terminate an employee over age if the employee is of the age of 40 and over. However, if an individual lacks necessary skill functions or has poor performance, who happens to be the age of 40 or over, the company is within its limits to terminate the employee. Because age is not a determining factor, the company is justified  in terminating the employee. Noncompliance of the Age Discrimination in Employment Act can cause extensive financial damage to a company. A victim of age discrimination can obtain compensation, including attorney’s fees, court cost, and monetary compensation and punitive damages from the business. There are certain guidelines associated with the amount of compensation a victim can be awarded if age discrimination is proven. Mr. Stonefield is anticipating on employing up to 25 individuals to operate his limousine company. According to the EEOC, employers with 15-100 employees, the limit for compensation and punitive damages is $50,000.00 per claim. Additionally, if an employer: â€Å"resist, oppose, impede, intimidate or interfere with a duly authorized representative of the [EEOC] while it is engaged in the performance of duties under [this law] shall be punished by a fine of not more than $500.00 or by imprisonment for not more than one year, or both† (Equal Employment Opportunity Commission, 2013, SEC. 629). The Americans with Disabilities Act of 1990 The Americans with Disabilities Act (ADA) was approved in 1990, which prohibits employers from discriminating against potential employees with disabilities. A qualified individual should be able to perform the essential duties of the job with or without accommodation. In Mr. Stonefield’s case, he would not be held responsible for not hiring a blind driver. However, if a blind individual has the qualifications to complete data entry job functions, Mr. Stonefield would need to make reasonable accommodations for the essential job functions. According to Cascio (2013, p. 111), â€Å"almost 13 percent of people ages 21 to 64 in the United States have at least one disability, a percentage that more than doubles to 30.2 percent for people ages 65 to 74†. It is also essential for Mr. Stonefield’s limousine location to be accessible for individual with disabilities (e.g. ramps, bathroom stalls, etc.). Additionally, Mr. Stonefield is not allowed to ask or discuss a potential employees past claims or medical history, as it would be in violation of ADA. The EEOC enforces the ADA; however, there are other avenues victims can make claims of discrimination (e.g. Attorney General’s Office, U.S. Department of Justice, etc.). Violation of the ADA, in  connection with the Texas Labor Code, can be subject to damages payable to victims. These damages can include back pay, punitive damages, mental anguish, and pain and suffering (State of Texas: Office of the Governor, n.d., para. 7). Caps are provided for the amount awarded to victims of such discrimination and is based on the number of employees working for the business. In Mr. Stonefield’s case, if he is found in violation of the ADA and because he has fewer than 101 employees, his cap would be $50,000.00. The Immigration Reform and Control Act of 1986 The Immigration Reform and Control Act of 1985 sets conditions around employer’s inability to hire illegal aliens. Companies can be sanctioned, and fined and the law relates to every employee. This law essential for Mr. Stonefield to adhere to, as in 2012 there were an estimated 1.7 million illegal immigrants residing in the state of Texas (SOLà S, 2013, para. 3). In order for Mr. Stonefield to comply with this law, it is essential he verifies the identity and the work status of all of the potential employees. Typically, most companies require new hires to fill out paperwork, such as an I-9, and obtain copies of identifiable documents (e.g. license, state issued identification, Social Security card, etc.). Companies that do not comply with this law can receive severe and harsh punishments and fines. According to Cascio, (2013, p. 110), â€Å"failure to comply with the verification rules, fines range from $100 to $1,100 for each employee whose identity and work authorization have not been verified†. Fines and penalties can range from $250.00 to $10,000.00 for each undocumented worker. Frequent or repeat offenders can be charged criminally. Texas law enforcement works with the federal agency Immigration and Customs Enforcement (ICE) to enforce the federal Immigration Reform and Control Act. Conclusion The employment compliance plan a general overview of the anticipated laws Mr. Stonefield’s limousine company can use to ensure the success of his business. Additionally, complying with the proposed employee compliance plan can save the company unnecessary expenses. Some of the most complicated  factors in establishing compliance with these laws are understanding the laws, knowledge of how these laws can affect the business, and the consequences if they are violated. As Mr. Stonefield will be operating a new company, it may be beneficial for him to hire a compliance officer to ensure he meets the necessary guidelines. My own role and responsibility in education and training Blatchford (2013) identifies that regarding professional conduct, a teacher is expected to show high standards, uphold public trust, act within the statutory frameworks, and have a proper and professional regard for ethos, policies and practices within the establishment in which they teach. As an Employability Skills Tutor, my roles and responsibilities can vary from session to session, although the fundamental rules apply daily. These include carrying out initial diagnostics, planning lessons, and preparing resources. Machin, Hindmarsh, Murray and Richardson (2013) identify that learner should be motivated by the teacher or tutor to develop both their ability and their aspirations to learn. Personally, I believe that my role is not just about the teaching of the subject matter. It goes a lot deeper into promoting social inclusions, working together, guidance and supporting each others ideas, and identifying individual needs. These are shown in the Teacher training cycle identified b y Ann Gravells (2012): Identification of need The need of the student is often gained through discussion, and through initial diagnostics relating to maths and English capabilities. The discussion between the learner and the teacher helps both parties to attain whether this is the right course, with the right materials and resource to succeed. Planning and Design One the identification of needs has been identified, then the planning and design of the individuals learning can begin. It is often a beneficial exercise to complete a learning style questionnaire suck as VAK, in order to identify the strongest learning styles and plan lesson to match those styles, such as kinaesthetic which is translated into ‘touching and doing’. Delivery/Facilitation Once a teacher is aware of the variation of learning styles with a class setting, then the delivery can be adapted to meet those styles to suit the lesson. If some learners prefer to be ‘hands on’, then a simple flipchart exercise can be agreed. This will also assist those who visual learners, as the flipchart can be presented back and also put on display, and these learners who are auditory learner’s can listen to the information presented back to them. Assessment Throughout the course, the teacher should be continually assessing the learners to ensure full understanding of the subject and the course work involved. This can be done in a number of ways, including small written work, looking at grammar and punctuation skills. Evaluation The teacher should also be continually evaluating the standard of the lesson, to see whether they are being successful in their approach to the class style of learning. Again, this should be adapted to reach all of the students. My learners have come onto the course as they have been unemployed for some time, and have often lost their confidence in their abilities and strengths. It is part of my role to instil those characteristics back into the learners, and guide them into the interview process. There are of course  boundaries that are in place Boundaries As a teacher or tutor, you must always maintain your boundaries. If learner sees you as more of a friend, then they may feel that they can push those boundaries with regards to lateness, inappropriate language, or general inappropriate behaviour. The boundaries between the teaching role and other professional roles are close together. For instance within other professions such as youth worker, the role becomes that of a mentor, guide and possible counsellor, and often learners can express themselves in a more ‘open’ manner. Within the nursing profession, the role becomes more of an observer for vital signs, listener, and carer. However, within the teaching role, there must be a clear boundary regarding ‘the relationship’. You are the leader, the one with the knowledge of the subject matter. Therefore, you should be ready to teach all students, and become involved in their ‘study life’ whilst maintaining and appropriate distance from their Ã¢â‚¬Ë œout of study life’. Relationships The relationship between the teacher and the learner should always remain professional. In the world of technology such as Facebook, it would be unsuitable for the teacher and the learner to become involved in each other’s personal lives, as this can impact into the teaching or any potential disciplinary processes than may need to be addressed. Before any actual classroom teaching can take place, initial and diagnostic assessments must be carried out. These are paramount in agreeing individual learning goals, and planning the progression of the learner with the teacher. Initial Assessment From the very beginning of the course, teachers should begin to analyse their learners through initial assessment methods. The assessments best suited to  guide improvements in student learning are quizzes, tests, writing assignments, and other assessments such as a group activity. These can easily give the teacher/tutor an insight into the learning needs of the learners. Also self-assessments such as the VAK (Visual, Auditory, and Kinaesthetic) learning styles questionnaire can also highlight the learner’s preferences to learning, as well as highlighting their understanding of the course that they are undertaking. This type of diagnostic assessment is useful within the teaching arena, as it highlights areas where the learner would benefit from extra support, or further training. During some courses, the initial and diagnostics assessments can be varied. My own experience of both initial and diagnostic assessments has been mixed as a reviewing tool. During spelling tests and grammatical sheets that needed writing on, my learning style as a visual learner was put to use, as I could read and re read the paper, and check the work that I had completed in both the English and the mathematical pieces. However, when it came to the bksb diagnostics, I felt more rigid and nervous, as I also had to concentrate on my hand eye coordination, moving the mouse to where the correct section should be, the classroom environment that I was in during the session, and a number of distractions from others. I feel that the bksb did not build my self-confidence and this can be detrimental in some cases. Each learner will have their own learning style and it is the role of the teacher to adjust these diagnostics to meet all learners’ requirements. There are a number of legislation requirements for people within the education sector, and below lists some of those points: Health and Safety The Health and Safety at Work Act 1974, describes duties of employers and employees. The most important is to make safe a place of work. The main rules are: to take care and not to injure yourself and others. to teach people to recognize symbols of danger to make safe place of work/ safe accesses to and from place of work to supply free protective equipment to have risk assessment to have general safe policy to ensure safe in areas of specific kind of risk like chemical, electrical, biological, physical area to ensure lit and ventilation to report injuries and near misses to follow special regulation like: COSHH factsheet, fire extinguishers factsheet, risk assessment factsheet, safety signs factsheet Equality and Diversity All organisations and teaching establishments now have an obligation to ensure equality and diversity is paramount to all learners. Acas (the Advisory, Conciliation and Arbitration Service), has a number of publications regarding the Equality Act 2010, and highlights the following protected characteristics: *Age *Gender Reassignment *Disability *Marriage and Civil Partnership *Pregnancy and Maternity *Race *Religion or Belief *Sex *Sexual Orientation The characteristics are protected against any form of discrimination. The implications for the teacher Data Protection The data Protection Act 1974 covers a wide range of confidentiality issues. However, within the teaching sector the points most relevant are: You must only collect information that you need for a specific reason The information must be kept secure The information should be relevant and up to date Safeguarding Dearne Valley College, quote the following within their policy (Ref S) : ‘Section 175 of the Education Act (2002) which requires FE colleges to make arrangements to ensure their functions are carried out in ways that ensure the safeguarding and welfare of children and young people, taking into account the guidance issued by the Secretary of State in considering what arrangements they need to make. Children Act (2004) Section 11 places a duty on local authorities and any person providing services in pursuance of section 74 of the Education and Skills Act 2008 to make arrangements with relevant agencies to cooperate to safeguard and promote the welfare of children (ie people under the age of 18). Every Child Matters: Change for Children (2004) set out the national framework for change programmes to build services around the needs of children and young people to maximise opportunity and minimise risk. Working Together to Safeguard Children (Dept for Education March 2013) states that all agencies and individuals should proactively aim to safeguard and promote the welfare of children so that the need for action to protect children from harm is reduced. Safeguarding Vulnerable Groups Act (HM Government 2006) provides legislative framework for the vetting and barring scheme for those working with children and vulnerable adults. It is the government’s response to Recommendation 19 of the Bichard enquiry 2004. Safeguarding Children and Safer Recruitment in Education (Dept for Education 15/10/12) this is the updated version which looks at the recruitment and selection process. The Disclosure and Barring Service (HM Government website 15/11/13) sets out the guidelines of the scheme which aims to prevent unsuitable people from undertaking certain paid or volunteer work with children or vulnerable adults ‘No Secrets’ Guidance (HM Government 2000 reviewed 2009) and related South Yorkshire policy Safer practice, safer learning (NIACE December 2007)’ Human Rights Citizens of the UK have certain fundamental human rights which government and public authorities are legally obliged to respect. These became law as part of the Human Rights Act 1998. Some of the most applicable human rights in a teaching environment are: the right to life (respect commitments of learners) freedom from degrading treatment (disrespecting learners) the right to liberty (freedom of expression within social limits) the right not to be discriminated against (promoting diversity and equal opportunity) the right to an education (the right to a fair education) Codes of Practice The institute for Learning, or IFL as it is better known, is the independent, member-led professional body for teachers, trainers, tutors, assessors and other professionals working across a variety of sectors, including sixth form colleges, further education colleges, and work based learning. It holds a multitude of information regarding teaching practice, and has a number of resources within the website. Teaching staff can learn about mew policies as they change, and can become members of the IFL. The IFL code of practice came into force in 2008. This covers the following points: Integrity Respect Care Practice Disclosure Responsibility As with all the above legislative requirements, the consequences to both the tutor and the student could be catastrophic. For instance, should a learner be having personal issues such as abuse, and is not performing the tasks or work set in the classroom, then it is the tutors responsibility to ensure that they address the issue with the leaner in an empathetic and confidential way, thus getting to the core of the problem, and not assuming that the student does not have the capability to do the work. Misreading any signs of such behaviour could result in the student become more and more withdrawn and possibly losing their place at the teaching establishment, purely based on the lack of support he or she has received. The initial training and on-going publications within the teaching establishment will enable the tutor to understand and comprehend the signs of any behavioural issues, whilst maintaining their knowledge of the legal requirements when teaching a class.
